This Privacy Policy explains how LexBar Virginia by Brightlex LLC, a Texas limited liability company (“LexBar,” “we,” “us,” or “our”), collects, uses, and shares information in connection with the LexBar online bar-preparation course and the website at virginiabarexamtutor.com (the “Service”). By using the Service, you agree to the practices described in this Policy.

1. Scope; United States Only

LexBar provides educational services only to residents of the United States and its territories, and is directed to individuals preparing for the Virginia Bar Examination. We do not market, sell, or knowingly provide services to residents of the European Union or other foreign jurisdictions, and we do not design our Service to comply with the EU General Data Protection Regulation (GDPR) or other non-U.S. privacy laws. This Policy is governed by the laws of the United States and the applicable laws of the State of Texas and the Commonwealth of Virginia.

2. Applicability of State Privacy Laws

Comprehensive state consumer-privacy statutes, including the Virginia Consumer Data Protection Act and the Texas Data Privacy and Security Act, apply only to businesses that meet certain volume, revenue, or other applicability thresholds. Based on the limited size and nature of our operations, LexBar does not meet the applicability thresholds of these statutes, and they therefore do not apply to our business. We do not voluntarily assume obligations that do not apply to us. We remain committed to handling your information responsibly and in accordance with the laws that do apply to us.

3. Information We Collect

We collect the following categories of information:

  • Account and contact information — such as your name and email address, which you provide when you enroll or contact us.
  • Payment information — processed by our third-party payment processor. We do not see or store your full payment-card details (see Section 7).
  • Course activity and progress — such as your quiz answers, lesson progress, and how you interact with course features.
  • Essay submissions — the written practice essay answers you upload for grading, which our graders review and return to you by email.
  • Communications — the contents of emails, support requests, and form submissions you send to us.
  • Usage and analytics data — such as device, browser, IP address, pages viewed, and similar technical information collected automatically through cookies and analytics tools.

4. How We Use Your Information

We use your information to:

  • provide, operate, and maintain the Service and your enrollment;
  • process your purchase and deliver the course you bought;
  • receive, grade, and return your practice essays;
  • conduct live online classes for plans that include them;
  • send you transactional and service-related emails;
  • send broadcast instructional emails (test-preparation tips and course guidance) to currently enrolled students who have opted in at checkout, while their enrollment is active;
  • respond to your questions and support requests;
  • analyze usage, monitor for errors, and maintain and improve the Service; and
  • protect the security and integrity of the Service and comply with applicable law.

5. What We Do Not Do

We do not sell your personal information. We do not share your personal information with third parties so that they can market or sell their own products or services to you. We do not use student information to market unrelated products. Our broadcast emails contain only our own test-preparation content and may occasionally mention the option to upgrade your LexBar plan; they never contain third-party advertising. We run no paid advertising and use no advertising or retargeting tracking technologies.

6. How We Share Information With Service Providers

We share information with third-party service providers only to the extent necessary to operate the Service and deliver what you purchased — never for those providers to market or sell to you. Our principal service providers include:

  • Stripe — processes payments and related fraud-prevention. You can review Stripe’s privacy practices at https://stripe.com/privacy.
  • PostHog — provides website analytics and error tracking that help us understand usage and maintain the Service.
  • Cloudflare — supports our email delivery, content delivery, video hosting, and website performance and security.
  • Zoom — hosts the live online classes included with certain plans.

We may also use other service providers that help us operate the Service. We may disclose information when required by law, to respond to lawful requests, to enforce our Terms of Service, or to protect the rights, property, or safety of LexBar, our students, or others.

7. Payment Processing

All purchases are securely processed by our third-party payment processor, Stripe. Stripe collects information about customer interactions with its service to provide its services, prevent fraud, and improve its offerings, which may include the use of cookies and IP addresses. Your banking and credit-card details are never seen or stored by LexBar or its staff. Stripe’s handling of your information is governed by Stripe’s own privacy policy.

8. Cookies and Tracking

The Service uses cookies and similar technologies to operate the site, remember your session, and gather analytics that help us maintain and improve the Service. We do not display a cookie-consent banner; by using the Service, you consent to our use of cookies as described in this Policy. You can usually control or disable cookies through your browser settings, though parts of the Service may not function properly if you do. We do not use cookies for paid advertising or cross-site retargeting.

9. Embedded Content

The Service may include embedded content (such as videos and images). Embedded content from other websites behaves as if you had visited the other website directly, and those websites may collect data about you, use cookies, and monitor your interaction with that content.

10. Data Retention

While your enrollment is active, we retain your account information, course progress, essay submissions, and related data to provide the Service. When your enrollment expires, your course progress and work are automatically and permanently deleted. After expiration, we retain only a record of the purchase transaction itself — your name, email address, the amount paid, the plan purchased, and the date — which we keep for accounting, tax, and recordkeeping purposes. Our payment processor separately retains transaction data under its own policies. Live-class recordings are stored locally for internal evaluation only, are never distributed, and are automatically deleted when the student’s enrollment expires.

11. Data Security

We use commercially reasonable measures to protect the information we hold. Payment-card data is handled by Stripe, and LexBar never sees or stores your full card details. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

12. Children’s Privacy

The Service is intended for adults preparing for the bar examination and is not directed to children. We do not knowingly collect personal information from anyone under the age of 18. If we learn that we have collected such information, we will delete it.

13. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the “Effective Date” above. Your continued use of the Service after a change becomes effective constitutes your acceptance of the updated Policy.
